Η απόφαση για την δημιουργία ελληνικής σημαίας πάρθηκε στην Ά εθνική συνέλευση της Επιδαύρου, το 1822. Τότε, σε άρθρα του υπό σύσταση συντάγματος, καθιερώθηκαν ότι τα χρώματά της θα είναι το λευκό και το κυανό. Στην κυβέρνηση ανατέθηκε ο καθορισμός του σχήματός της. Πράγματι, λίγο αργότερα, η κυβέρνηση με διάταγμά της καθώρισε τις διαστάσεις και το σχήμα των δύο μορφών σημαίας, της “ξηράς” (κυανόλευκος σταυρός) και της “θαλάσσης” (περίπου η σημερινή μορφή της). Αργότερα, κατά την επιθυμία των εκφραστών διαφόρων πολιτευμάτων που ίσχυαν κατά καιρούς στην Ελλάδα, υπήρξαν προσθαφαιρέσεις στα εμφανιζόμενα σύμβολα της σημαίας (π.χ. βασιλική κορώνα) και μικροτροποποιήσεις στις διαστάσεις της. Η οριστική μορφή της σημαίας που έχουμε σήμερα προβλέπεται στον νόμο 851/1978 (ΦΕΚ 233/τ. Α΄).
